On the 11 day of May 2022 the Spatial Planning Committee of the La-Nkwantanang Madina Municipal Assembly responded to the Church of Pentecost, GreenHill Assembly.
In the response, the committee refused the approval of the development application by the church based on the grounds that the land was marked and zoned for Residential land use.
The Spatial Planning Committee of the La-Nkwantanang Madina Municipal Assembly further provided this contact (0208764170) for further clarification.
Sources close to the MCE indicated that there was a lawsuit to that effective stating that, the buyers of the land were aware that the land was marked as a residential area even before acquiring the land from the buyers of the land.
ADDO Asiedu & Co. Acted as Solicitors for and on behalf of Mr. Ken. Balarabi Amponsah and served La-Nkwantanang Madina Municipal Assembly, indicating that, by a lease agreement dated 26th day of July 2017 he acquired a parcel of land from a large tract situated at Oyarifa -Accra from Nii Tsakley Akoboa and Animeley families of Oyarifa per it’s lawful representative Mr. Emmanuel Nai laryea and Mr. Sammuel Tsakley Boye. Pursuant to the afore-mentioned agreement, they requested the land to be used for RESIDENTIAL purposes ONLY.
In pursuant to LAND USE AND SPATIAL PLANNING ACT 2016, ACT 925, the Solicitors indicated what the laws of the land stipulate.
Addo Asiedu & Co. Solicitors indicated that the La-Nkwantanang Madina Municipal Assembly should ensure that the development of the land conforms to the laws of rezoning of the said land.
In effect, copies from the Solicitors were served the Municipal Engineer, the Municipal Planner, and the Church of Pentecost as well.
This comes to confirm what Hon. Kwatia indicated that there could be a lawsuit as far as the Church of Pentecost land is concern.
The reaction from the MCE was that she did not “goof” in her statement and that she should be quoted correctly. As to whether the apology from the MCE will come, only time will tell.
